ONLINE EQUIPMENT RENTAL AGREEMENT
This Online Equipment Rental Agreement (the "Agreement") is made and entered into by and between Canada Camera Rentals, a division of Bow Valley Films Ltd. (the "Lessor") a limited company duly organized under the laws of the Province of Alberta, and the guest or registered user completing the online rental process ("You"). By clicking "I Agree" at checkout, You acknowledge that You have read, understood, and agree to be bound by the terms of this Agreement.
Lessor agrees to lease to You, and You agree to lease from Lessor, the equipment selected during the online checkout process (the "Equipment"), subject to the terms and conditions herein. The Equipment remains the sole property of Lessor. You shall not sublease, lend, modify, or tamper with the Equipment. You further agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purpose any portion of the Equipment, the services provided by Lessor, or access to such services, except as expressly permitted in writing by Lessor. Any unauthorized commercial use or attempt to profit from Lessor’s Equipment or services without consent shall constitute a material breach of this Agreement.
The rental period begins on the scheduled rental start date, with the Equipment being shipped to arrive the day before. The return date is the day after the scheduled rental end date, at which time the courier will collect the Equipment. If You opt for pickup, Equipment must be collected by 10 AM and returned by 11 AM.
Late returns are subject to a daily late fee equal to the standard daily rental rate, charged for each day the Equipment is overdue. Extensions may be granted at Lessor’s discretion and will be charged at the standard three-day week rate. If the Equipment is not returned within seven (7) days of the due date, it will be considered stolen, and You will be charged the full replacement cost. If the Equipment is subsequently returned, Lessor may, at its discretion, issue a partial refund, less applicable late fees and any costs incurred.
If You miss the scheduled courier return collection, You must notify Lessor immediately to arrange a rebooking. A one-time rebooking may be provided at no additional charge, but failure to facilitate the return may result in additional charges and continued late fees. Any outstanding amounts will be subject to Section 13 (Default & Remedies).
Early returns may be accepted if mutually agreed upon by both parties. You must notify Lessor in advance and comply with the return procedures outlined in this Agreement. An early return does not guarantee a refund or rental rate adjustment unless explicitly approved by Lessor. If You choose to terminate the rental early, an early cancellation fee may apply, and You will be responsible for any costs incurred by Lessor in recovering the Equipment.
Pricing, security deposit requirements, and waiver options vary depending on Your rental profile and the value of the rented Equipment. Deposits or waiver premiums may be required at the time of booking and may be taken as a pre-authorized hold or a full charge, refundable upon return and inspection of the Equipment, provided no damage or loss has occurred. Payment for rental charges, shipping fees, and security deposits must be made at the time of booking. Refunds will be processed within ten (10) business days. Any disputes regarding the deposit must be raised within seven (7) days of the return date. Lessor reserves the right to correct pricing errors and adjust availability as needed without prior notice.
Lessor offers free pick-up at its premises in Canmore. Delivery is available for an additional fee, calculated at checkout. Equipment will be shipped via a reputable courier service (e.g., Purolator or UPS) in protective packaging, including a prepaid return label. Lessor does not guarantee specific delivery times or dates; any shipping time provided is only an estimate and You must report any issues within 24 hours of the scheduled delivery date. Delivery delays do not permit cancellation once the Equipment is shipped, as outlined in Section 9. If delivery is delayed, Lessor will provide a rental extension or a partial refund (calculated as a fraction of the total rental cost based on the rental period) proportional to the delay. You assume full responsibility for the Equipment once it has been delivered to You or Your designated carrier. If the Equipment is damaged in transit, You must notify Lessor immediately and return it, barring which the Equipment will be deemed accepted as received. Lessor will resend replacement Equipment if available.
You agree to use the Equipment only for its intended purpose, in compliance with all applicable laws, ordinance, regulations and Lessor’s instructions in any way relating to the use or possession of the Equipment. You are responsible for maintaining the Equipment in good working condition and must report any issues within twenty-four (24) hours of discovery or receipt, whichever is earlier, after which the Equipment will be deemed accepted as received and any subsequent damage will be presumed to have occurred while in Your possession. You are strictly prohibited from removing, replacing, or swapping any parts, components, or accessories of the Equipment, including but not limited to lenses, batteries, mounts, or other removable parts. Any such unauthorized modifications will be treated as damage, and You will be liable for the full cost of restoring the Equipment to its original condition.
You acknowledge that the operation of drones is a regulated activity subject to federal, provincial, and local laws, including but not limited to Transport Canada regulations. It is Your sole responsibility to obtain all necessary permits, licenses, and authorizations required for the legal operation of any rented drone. You agree to comply with all applicable laws, airspace restrictions, and safety guidelines while using the Equipment. Lessor assumes no responsibility for Your failure to obtain required permits or comply with regulations. You agree to indemnify, defend, and hold harmless Lessor from any claims, penalties, fines, damages, or liabilities arising from Your operation of the drone, including but not limited to violations of aviation laws, property damage, personal injury, or unauthorized flight operations.
You assume full responsibility for the Equipment from the time the courier delivers it to You until pick up to return it to Lessor. If the Equipment or any accessories are lost, stolen, or damaged beyond repair, You will be charged the full replacement value. If repair is needed, Lessor will determine the method and venue, and You will be responsible for all reasonable costs. If You have purchased the optional Insurance Add-On, Your liability for covered damage will be limited per Section 8, provided the damaged Equipment is returned.
You may be required to maintain valid insurance coverage, including comprehensive general commercial liability insurance providing coverage for bodily injury and property damage, sufficient to cover any potential claims related to the use of the equipment and the Lessor shall be named as an additional insured. If required, You must provide proof of insurance covering the rented equipment for its full replacement cost. The requirement for insurance will be determined at Lessor’s discretion based on the value of the Equipment. If offered, You may elect to purchase an optional Insurance Add-On to limit Your liability for repairable damage, subject to an additional fee based on the Equipment rented which will be added at the time of booking. This coverage does not apply to total loss, theft, water damage, intentional acts, or damage that results from actions beyond the normal operational use of the Equipment, including but not limited to misuse, neglect, rough handling, exposure to extreme conditions, or operation outside of the manufacturer’s recommended guidelines, which exceeds normal wear and tear. To qualify for coverage, damaged Equipment must be returned at the end of the rental period. Lessor reserves the right to determine the extent of covered damage and assess repair costs. Missing accessories are not covered under the Insurance Add-On, and all associated replacement costs will be charged to Your payment method on file.
You may cancel an order up to 48 hours before shipment for a full refund. Cancellations made within 48 hours of shipment will incur a 30% cancellation fee. Once the Equipment has been shipped, cancellations are not permitted, and rental charges apply in full. Lessor reserves the right to cancel any order at its discretion before shipment and issue a full refund.
You assume all risks associated with the possession and use of the Equipment, including but not limited to property damage, personal injury, or loss. You agree to indemnify, defend, and hold harmless Lessor from any claims, damages, costs, or expenses arising from Your use, misuse, or failure of the Equipment, including any third-party claims. Lessor does not assume, and You expressly indemnify Lessor against, any liability or claims resulting from the use or malfunction of the Equipment. The services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Lessor and third parties connected to it expressly disclaim all warranties, conditions and other terms of any kind, whether expressed or implied, including, but not limited to any implied term of merchantability, satisfactory quality, fitness for a particular purpose, and any term as to the provision of such services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right. Lessor is not liable for any third-party claims, injuries, or damages resulting from Equipment failure, misuse, or operation. You agree that the liability of Lessor, if any, arising out of this rental agreement, is limited to money damages not to exceed the total of prior payments made under this agreement or equitable adjustment of the rental payments. Lessor shall not be liable for any indirect or consequential damages, losses or expenses of any nature or kind whatsoever. This does not affect Lessor’s liability for death or personal injury arising from its gross negligence, nor its liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
All Equipment remains the exclusive property of Lessor. You shall not remove, alter, or obscure any identifying marks on the Equipment. Any attempt to sell, transfer, or encumber the Equipment will be considered theft and prosecuted accordingly.
Lessor reserves the right to terminate this Agreement and demand the immediate return of the Equipment if You breach any terms herein. If the Equipment is not returned within seven (7) days of the due date, it will be considered stolen, and You will be charged the full replacement cost. Failure to comply may result in legal action and the application of late fees as specified in Section 2, and additional charges for any costs incurred by Lessor in recovering the Equipment, including legal fees and collection expenses.
In the event of default, all outstanding amounts owed become immediately due. You shall be responsible for any reasonable costs incurred by Lessor in recovering outstanding balances, including collection fees and legal expenses. Lessor reserves the right to pursue all available civil and criminal remedies, including recovering possession of the Equipment, charging Your payment method, engaging debt collection agencies, and filing legal claims.
Lessor shall not be held liable for any delay or failure to perform its obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, strikes, labor disputes, pandemics, supply chain disruptions, power failures, or any other event that makes performance impossible or impracticable (“Force Majeure Event”). If a Force Majeure Event occurs, Lessor’s obligations shall be suspended for the duration of the event. In the event of a delivery delay caused by a Force Majeure Event, rental charges will not apply until the Equipment is delivered. If the Equipment is delivered partway through the original Rental Period, You will only be charged for the remaining Rental Period. Lessor shall not be liable for any indirect, incidental, or consequential damages arising from delayed delivery, including but not limited to losses incurred in film productions or other time-sensitive activities. If the event continues for more than thirty (30) days, either party may terminate this Agreement by providing written notice, with any prepaid amounts refunded for the unused portion of the rental period, less applicable fees.
Access to Lessor’s website is provided on a temporary basis, and Lessor reserves the right to modify, suspend, or discontinue any part of the website or its services without prior notice. Lessor shall not be liable for any interruptions, modifications, or unavailability of the website. Lessor may restrict access to certain sections of the website or require registration for specific services. Lessor makes no guarantees regarding the accuracy of information posted on the website. Users should not rely on website content as professional advice, and Lessor disclaims all liability arising from any such reliance.
Lessor is concerned about the safety of all users, particularly children. If You allow a minor to access the website, You assume full responsibility for monitoring their activity and ensuring compliance with these terms.
Lessor processes personal data in accordance with the applicable privacy laws of Alberta and Canada. By using the website, You consent to such processing and confirm that all data You provide is accurate. You acknowledge that any content You share on publicly accessible areas of the website may remain available indefinitely. You are responsible for ensuring that any content shared does not infringe on third-party intellectual property rights. Lessor reserves the right to modify, suspend, or terminate the website at any time for maintenance, updates, or other reasons without notice. Lessor is not responsible for any data loss resulting from such modifications. Users are encouraged to keep backups of any content submitted to the website.
You agree to comply with all local laws regarding online conduct and data transmission, including any applicable export regulations. You further agree to indemnify and hold Lessor and its employees harmless from any claims arising from content You submit, Your use of the website, or violations of these terms.
You must not upload, post, or transmit any unlawful, harmful, or offensive content through the website. Lessor reserves the right to remove any content that violates these terms and may disclose user information as required by law. You are solely responsible for any content You upload and agree to indemnify Lessor against any claims arising from such content. Any attempt to interfere with the website’s functionality, distribute malware, or engage in fraudulent activities is strictly prohibited and may result in legal action.
If Lessor considers that a breach of the rules has occurred, Lessor may, at its sole discretion, take such action as it deems appropriate, including but not limited to suspending or permanently revoking Your access to the website, pursuing legal claims, or reporting violations to law enforcement. Lessor is not liable for any consequences resulting from actions taken in response to breaches, including account suspension or legal proceedings.

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Alberta and applicable federal laws of Canada. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Alberta.
This Agreement, including any policies referenced herein, constitutes the entire agreement between You and Lessor and supersedes any prior agreements, discussions, or understandings, whether written or oral. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the court shall endeavor to give effect to the parties’ intentions as reflected in the original provision.
Failure by Lessor to enforce any provision of this Agreement shall not be deemed a waiver of such provision or any other rights under this Agreement. You may not assign or transfer any rights or obligations under this Agreement without Lessor’s prior written consent.
Lessor reserves the right to modify this Agreement at any time. Any updates will be posted on the website, and continued use of Lessor’s services after such modifications constitutes acceptance of the updated terms. You are responsible for reviewing the Agreement periodically for any changes.
